LMBPN® Publishing appreciates that you've provided your manuscript to us for possible publication. This Agreement sets forth your rights and the rights and obligations of LMBPN to and concerning all submissions. This Agreement is necessary to avoid misunderstandings or confusion and to protect everyone concerned. Please be aware that LMBPN will only accept your submission if you agree to the terms outlined in this Agreement.

Original Works. LMBPN will only accept content through our submission form on our website. Your submission will only be considered at your request, and with your guarantee that you are the originator of all contents of the submission and you have the legal right to submit it to LMBPN for consideration.

Disclosure to LMBPN. You accept that LMBPN may discuss your submission with its associates to evaluate its potential for publication. You agree that any consideration of your submission does not create a confidential relationship between you and LMBPN.

No Implied Contract. You agree that no contract or obligation of any kind is assumed or may be implied if LMBPN accepts and/or reviews your submission and/or enters into any discussions or negotiations with you. Specifically, you expressly agree that your submission of materials, LMBPN's review of your submission, and its willingness to discuss your submission with you do not constitute or create an implied-in-fact or implied-in-law contract, even if an industry custom to the contrary exists.

Protection. You understand that LMBPN develops content for entertainment and other properties from ideas generated by its employees and/or other outside sources and that LMBPN may have access to and/or may have independently created in the past, be in the process of creating, or create in the future ideas, concepts, or other materials that are similar or identical to your submission. You understand that it is not uncommon for more than one individual or company to originate substantially similar ideas independent of each other. You hereby renounce all claims that LMBPN misappropriated any ideas or portions of your submission in any future LMBPN property or activity, except as outlined in the immediately following paragraph.

Compensation. You agree that your entitlement to any compensation is dependent on a written contract separate from this Agreement, signed by both parties and specifically related to LMBPN's use of your submission. If you and LMBPN do not enter into such a written contract, you will not be entitled to any compensation from LMBPN related to your submission. You further understand that LMBPN will only have an obligation to get permission from you and to compensate you for those portions of your submission that are expressed in sufficient detail that they are protected under copyright law or other intellectual property laws.

No Acknowledgement of Intellectual Property Rights. You understand that neither LMBPN's consideration of your submission nor its willingness to negotiate a potential written contract with you regarding your submission shall constitute an acknowledgment or acceptance by LMBPN that you have any protectable copyrights, trademarks, or other intellectual property rights in your submission. You further understand that LMBPN has not waived its rights to contest any copyrights, trademarks, or other intellectual property rights you may claim to have in your submission.

Submission Not Returned. LMBPN is not obligated to return your submission to you. You should keep a copy of any materials submitted. Do not send any materials you consider irreplaceable.

Modification in Writing Only. The above conditions may not be changed or waived except in writing and signed by an officer of LMBPN.

Blanket Release Form. By accepting this Agreement, you acknowledge and agree that these terms will hereby apply to all current as well as future submissions and that LMBPN will not consider any submission from you without your acceptance of this Agreement. You also agree that this Agreement applies to any work previously submitted by you to LMBPN, regardless of whether the previous submission was submitted under a prior version of this Agreement or without any agreement.

Binding on All Parties. To avoid doubt, please note that this Agreement applies to individuals signing on behalf of themselves and to individuals who submit materials on behalf of others (e.g., a partnership, company or other persons or legal entities), and is binding on all such others as well. To accept the terms of this Agreement, you must be the owner of or an authorized representative of the owner of the materials in the submission. Also, if signing on behalf of others as described above, you must have the legal right to accept the terms of this Agreement on their behalf.
